I. Patent Authorizations We obtained 194 patent grants in China (based on the issuance date of authorization notices) this month, including:
43 invention patents. 103 utility model patents. 48 design patents.
For international patents, we secured 4 grants, comprising: 3 invention patents. 1 utility model patent.
Key jurisdictions include the United States, Japan, and South Korea.
II. Key Legal Case Updates
1. Invention Patent Reexamination Decision (No. 1831374) Following a pre-examination review, the initial rejection decision was overturned. The case has been remanded to the original examination department for further proceedings.
2. Copyright Infringement Dispute (Case No.: [2024] Yue 0305 Min Chu 24480) Representing the defendant, the court ruled in the first instance that the plaintiff’s work “lacked the originality required for copyright protection under Chinese law” and dismissed all claims. The judgment is final and binding as a first-instance ruling.
3. Utility Model Patent Infringement Case (Case No.: [2023] Yue 73 Zhi Min Chu 2018) Representing the plaintiff, the court ordered the defendant to immediately cease infringement and awarded damages of CNY 130,000 in the first-instance judgment.
